Well folks, I received an "Order After Hearing on Alleged Custody/Parenting Violation" today that was dated 11/22/2005 and Certified to be mailed out on November 23, 2005. The funny thing is that the Kent County FOC have committed more suspect acts against me, even if order received was a valid order and even if the original show cause was a valid order. Kent County Friend of the Court employee Holly Pietila certified her Proof of Service stating that the Order and Petition (which is wrong) was placed in the mail on November 23, 2005. The postmark by their Pitney Bowes postage meter is CLEARLY November 28, 2005. They have again lied and have attempted to delay an Order so that it is more difficult to file an Objection and response to their clearly bogus proceedings. Stay tuned for more on this subject.

Does Kent County Circuit Court Referee, Marie Kessler, need to go back to law school...
That is all I can say right now because I'm no attorney but can definitely tell a railroad job when I see it, so can others...
I am still in such disbelief of the incompetence of Kent County Staff. Marie Kessler was the "Referee" for an Administrative Hearing today. Needless to say the Order to Show Cause was a VOID ORDER and I served all parties a formal Objection to that affect. Ms. Kessler proceeded anyways, against my Objections, my Oral Motion to Disqualify her on Due Process Grounds, my Objection to FOC Recommendations which had no basis in law or evidence... This is all after I discovered they didn't want to hear my Objections and I moved for a Judicial Hearing pursuant to MCR 3.215... She also stated that I could not object to statements made by Ms. McMenamin regarding testimony, so in essence suspended all of the ability to facilitate the record... There were no rules of evidence allowed. Just Hearsay evidence by the FOC Representative, Linda Jackson.
She also improperly found a civil contempt against me, despite no evidence being entered, no prior demand by plaintiff, and no willful misconduct on my part. A small fine for a past act, which is clearly "punative in a nature." Bear in mind that these are only a small number of arguments that would occur IF THE HEARING WAS EVEN LEGITIMATE.
I have more confidence in my "Jones Soda fortune" that said LAUGH OUT LOUD (REALLY LOUD) before my attendance and almost had to submit it is Exhibit A. Jones Soda is clearly more wise then the Judiciary Machine in Kent County. More on these events later. Luckily there were courtwatchers that were present to see just how ridiculous the Administrative Proceedings were!
Motion to Object; Motion to Set Aside Order, et al.
Well the following was served upon Circuit Court Referee Marie Kessler, Annalise McMenamin, Linda Jackson, and the Clerk. The objection is clear, the Order to Show Cause is a VOID Order. I have also moved to Strike Unsupported Declaration of John R. Cole, Motion for Contempt Against John R. Cole and a Request for Liquidated Damages as a result of the Void Order and lack of compliance with the Court Rules and the atmosphere of impropriety committed by Judge G. Patrick Hillary in signing the very type of Order he just Set Aside in September. Please note most of the exhibits referenced in the Pleading are here on the Website already. Particlarly the letter of October 31, 2005 and Motion to Suspend Automatic Enforcement, et al.

Courtwatchers
Please take notice that Courtwatchers for the hearing scheduled for November 22, 2005 at Kent County Circuit Court will take place in Room 4E. The Kent County Court House is located at 180 Ottawa Ave. NW, Grand Rapids, MI 49503. The scheduled time to begin is at 2:15pm. If you come to an empty room, immediately check with the Clerk of the Court or the front desk. I will also be greeting folks before hand. The Referee "appointed" to the quasi-judicial hearing is Marie Kessler.

Thomas Jefferson was right ...
It has been 10 days since I issued my letter to Judge G. Patrick Hillary, the Friend of the Court, and opposing counsel in the Kent County custody matter involving my two children. The only thing received so far is a copy of a pleading that was dated the day AFTER my request demonstrating the involvement of the Kent County friend of the court staff attorney Dan Fojtik still meddling with my case. The post mark shows that the pleading filed by Dan Fojtik, improper as it was, was actually mailed out on November 2, 2005. It is apparent that the court only cares about money and that ultimately Judge Patrick Hillary's complete disregard for common sense in this matter by allowing the foc to continue forward despite my request reinforces that shake down corrupt mentality that these officials have with regard to child custody cases. These officials benefit from Federal Incentive payments and want to extort every penny they can out of a system to support their fat diets and otherwise unjustified cushioned jobs. Please continue to contact me about your cases and your experiences with these "fat cats."
