Who is Keeping Score... Well, since Kent County Circuit Court Officials and the Kent County Friend of the Court recently become aware of my involvement in designing the cute website for Sally B., a Grandmother who is not being allowed to raise or see her own grandchild because Judge Kathleen Feeney, determined it is best to give a child to a non-relative... the result, more state funding for Michigan from the Federal Government as a result of a successful adoption to a non-relative as well as temporary placement with a non-relative.

Friday was busy for a few employees at the Kent County building. I filed a grievance or two against Kent County in the past for browsing the web on the taxpayer dime, and they actually said I "couldn't possibly determine who and for how long" the court employees were wasting time on government owned computers.

Some of the other judges can expect websites up in the next couple of weeks. I am finding they [the robed demigods] have each aggravated a ton of people. I have names and addresses totaling in the thousands regarding rulings of Kent County Judges for any lawyer that wants to step up and run against a few of these judges in Kent County.

People Want To Unelect Judge Kathleen Feeney! Grand Rapids, MI

Well you heard it here first folks. There are several people that want to see Judge Kathleen A. Feeney of Kent County, Michigan UNELECTED! It is fun and easy to get rid of a judge, because they seem to make a lot of people dissatisfied with their court rulings. There is a nice flyer that you can print off and send to the Judge's co-workers as well.

A Few Kent County, Michigan Judges Should Be Sent A Copy of the Same Order

I know some Michigan Judges and Attorneys that could benefit from a similar order, ordering them back to basic law school regarding the United States Constitution and the State of Michigan Constitutions and the limitations of government intrusion within the realm of protected liberties.

Judge Steven M. Pestka? Judge G. Patrick Hillary? Attorney Peter P. Walsh? I guess using the questionable chancery powers of equity of the U.S. Court System would technically allow for such a ruling as described by an Associated Press reporter.

Gavin Rabinowitz reports for the Associated Press earlier today that an Indian Court in New Delhi decided to send one of the lower court justices back to law school, see excerpts below.

New Delhi's High Court justices, annoyed with lower court judges who issue problematic rulings, have decided to send one of them back to law school.

In an order issued late Friday, Judge R. K. Tiwari was told to return for a three-month refresher course after issuing an arrest warrant in defiance of a previous High Court ruling.

"Since Tiwari does not have even elementary knowledge of the criminal law and procedure it would be appropriate that he undergoes a refresher course at Delhi Judicial Academy," Justice V. B. Gupta wrote.
Gupta ordered that the head of the law school personally submit a report on Tiwari's progress after three months. And, to ensure that others in lower courts got the message, Gupta ordered copies of his order sent to all New Delhi judges.

If only these remedies were used in Michigan, the legal system would likely see immediate improvements and courtroom efficiency would skyrocket in an honest and equal manner.

Meet Susan Borovich, St. Clair County's Slave Master

This woman's name is Susan Borovich, employee to the St. Clair County Judges as the Director of the Friend of the Court, St. Clair's Title IV-D Welfare department. She is smiling because she just became the head slavemaster. Under her "oversight" she will be involved with the Jail Alternative Plan, a program that forces its residents into an Indentured Servant program for no pay and will likely take away several paying jobs normally available to the general public. Be sure to watch for her at public locations and tell her what you think!

Read the background on the Thirteenth Amendment regarding slavery and indentured servitude as well as understanding more about the State impairment of contracts. In the meantime while you study up, watch for this lady and tell her to get a real job instead of praying on Title IV-D Welfare participants that are largely already self-sufficient residents that should not be trapped by the system at taxpayer expense.

Jail aims to put child-support violators to work
Work-release program includes help finding regular jobs

St. Clair County officials hope a new program will free up bed space at the county jail and help some inmates find jobs.

The Jail Alternative Program, which will be overseen by St. Clair County Friend of the Court, will allow certain inmates sentenced for not paying child support to serve their sentences outside jail.

The program will work in conjunction with the St. Clair County Parks and Recreation Department by having some of the inmates work at county parks while on work release from the jail, said Susan Borovich, director of Friend of the Court. While the inmates will not be paid, they will be required to look for a job through Michigan Works while in the program.

"The end result, we believe, is going to instill more pride in the person that's not paying child support," Borovich said. "And it will allow them time to find a job, so the end result is they will make regular child-support payments."

Officials hope to start the program in the spring or early summer.

Costs for the program, which would include hiring an on-site supervisor, buying a van to transport the inmates, uniforms, and other items such as a radio or cell phone for the supervisor, would be paid for with federal money through the Friend of the Court division and money from the county parks millage. The cost of the program is not yet known.

To be eligible for the program, an inmate must first make a minimum payment to the custodial parent, the amount of which will be determined by a judge; have no history of violent offenses, sexual assault or personal-protection orders; and be someone who had been making regular payments but stopped because of something such as losing a job.

Officials envision the program working like this:

Participants will meet at 8:30 a.m. daily at the county jail where they will be transported to a park and work until about 2:30 p.m. After that, they will be required to go to Michigan Works where they will try to find a job, work on a résumé or learn job skills.

When the Michigan Works office closes, they would return to their homes.

"I think it's a great initiative," county Administrator Shaun Groden said. "It shows real creativity and acknowledgement that we need to manage our (jail) bed space and look at who is in jail and why."

St. Clair County jail administrator Maj. Tom Torrey said as of Thursday morning, there were 34 people in jail for not paying child support. He said about 20 likely would be eligible to participate in the program.

Torrey anticipates the program will free up bed space that can be used for violent offenders or rented to federal inmates. He hopes to expand the program to other nonviolent offenders.

"I've always taken the stance that we have too many people in jail that are only here because they don't have money," he said. "This would open up beds for people who are a threat or to federal prisoners to bring in money for the general fund."

Holland Prepares Filing In State Supreme Court Against Kent County

On Friday January 5, 2007 both a Request for Investigation of Courts with the State Court Administrator's Office and a Complaint for an investigation with the State Bar of Michigan were filed against the 23rd Circuit Court in Kent County Michigan and several employees. The filings are an introduction to a Complaint for Superintending Control and Petition for Order to Show Cause with the State Supreme Court against the Kent County Circuit Court, Kent County Circuit Court Judge G. Patrick Hillary, the Kent County Friend of the Court, Friend of the Court Caseworker Douglas Schumacher, and Friend of the Court Staff Attorney Daniel Fojtik and aims to prevent the use of non-lawyers by the local court to conduct actual legal proceedings against parties involved in domestic relations matters.

The use of non-lawyers, individuals not otherwise licensed by the State Bar, to conduct actual legal proceedings is forbidden by Michigan law under the Unauthorized Practice of Law statute (See MCLA 600.916). Similarly MRPC 5.5(b) prevents lawyers and judges from assisting an individual in the Unauthorized Practice of Law among other ethical restrictions placed on the conduct of lawyers and judges.

Several remedies are available to help resolve this very important issue under MCR 8.113(B) before having to file the original action with the State Supreme Court. They include:

(1) attempt to informally resolve the dispute,

(2) inform the complainant that an investigation pursuant to this rule is not appropriate under the circumstances,

(3) direct the complainant to the Judicial Tenure Commission or the Attorney Grievance Commission,

(4) request an investigation by the Judicial Tenure Commission or the Attorney Grievance Commission,

(5) refer a matter to the Supreme Court for possible exercise of the Supreme Court's power of superintending control over the judiciary, or

(6) take any other appropriate action.

It is possible that as a result of the Complaint that I am directed to various ethical grievance processes which would be ineffective at ensuring litigants are protected against non-lawyers conducting actual legal proceedings. The State Supreme Court would then be used to file the full Complaint for Superintending Control and Petition for Order to Show to resolve the dispute.

Additionally the State Bar of Michigan has remedies to ensure that exceptions are not made to the Unauthorized Practice of Law, file injunctions, and bring ethical complaints against individuals and those assisting individuals that engage in the Unauthorized Practice of Law in Michigan courtrooms.

MOTION TO COMPEL DISCOVERY

NOW COMES, the Defendant, Lary Holland’s (Pro Se), Motion to Compel Discovery and represents and states as follows:

Lary Holland is a party/litigant in the case number 03-09173-DC.
That Daniel J. Fojtik and John R. Cole are non-parties to the above captioned civil lawsuit and are both employees of the 17^th Circuit Court, which may have information that will likely lead to evidence to be used in the above-captioned matter.
That on April 20, 2006 Judge G. Patrick Hillary signed a Subpoena directed to John R. Cole, a judicial employee acting as Friend of the Court, to appear personally on 5/3/2006 at 9:30am to testify at trial and to Produce/Permit inspection or copying of several items. See attached Exhibit A, hereinafter referred to as “Cole Subpoena.”
That on April 20, 2006, Judge G. Patrick Hillary signed a Subpoena directed to Daniel J. Fojtik, a judicial employee who is acting as legal counsel for the Kent County Friend of the Court, to appear personally on 5/3/2006 at 9:30am to testify at trial and to Produce/Permit inspection or copying of several items. See attached Exhibit B, hereinafter referred to as “Fojtik Subpoena.”
That throughout the case Daniel J. Fojtik was placed on the record as formerly “appearing on behalf of” John R. Cole and the Kent County Friend of the Court.
That on April 28, 2006 the hearing scheduled for May 3, 2006 was adjourned without future date.
That no Motion to Quash was brought by the Kent County Friend of the Court regarding the Fojtik Subpoena or the Cole Subpoena and no objection was raised as to the substance of the subpoenas. A subpoena remains in effect through the duration of the case unless quashed.
The substance of both the Fojtik Subpoena and the Cole Subpoena were presented through Judge G. Patrick Hillary’s office and subsequently signed, similarly Judge G. Patrick Hillary has made the assertion to the Defendant in the past that he reads everything that is presented to him.
That on May 4, 2006 a Request for Production to Non Party was sent to both John R. Cole and Daniel J. Fojtik individually with substantially similar and in some cases the same requests that were made with the above referenced subpoenas. See attached Exhibit C & D, hereinafter referred to as Request for Production(s) collectively.
That the time for filing of an Objection to both “Request for Productions” has passed and that neither an Objection was filed nor a Motion for Protective Order in response to the Request for Productions.
That in a letter dated 5/7/2006 Daniel J. Fojtik acknowledges receipt of both Request for Production(s) and indicates that if [Defendant] disagree with his letter to “feel free to file whatever motion [Defendant] think is appropriate” acknowledging his willful failure to act on the Request for Productions and thereby forcing Defendant to file this motion.
A failure to act is not excused on the ground that the discovery sought is objectionable, unless such objection is properly presented, and Daniel J. Fojtik has simply failed to respond to the requests on behalf of John R. Cole and himself.
That John R. Cole and Daniel J. Fojtik owe answers to the Request for Productions to Defendant.

WHEREFORE, Defendant prays that this Court grant the following relief:

A. Order Daniel J. Fojtik to provide full and complete answers in his own capacity and in his representational capacity of John R. Cole within the next 7 days.

Response to Deliberate Delay by Judge G. Patrick Hillary's Staff

I faxed a complete response to Beverly Golsdworthy who also works in Judge G. Patrick Hillary's Office after receiving the deliberately delayed and backdated letter from Jacqueline Flowers. I reiterated the events up to this point so that if the tapes are suddenly altered, destroyed, or unavailable, further actions can be taken against these corrupted actors.

RE: Request for Transcript/Events Leading up to May 9, 2006

First, I apologize for making this longer than necessary, but felt it important enough to make a public record of the events leading up to this point.

On May 1, 2006, I sent a letter that was also directed to Court Reporter/Court Reporting Services. Since Jacqueline Flowers was the individual that the Records Department referred me to earlier that day regarding obtaining an audio cd of the events on April 28, 2006.

On May 4^th, 2006 a second letter was sent out after no response was received from the Office of Judge G. Patrick Hillary on the previous issues and reiterating that no response had been received. No response was received.

On May 8^th, 2006 I finally received a letter in the mail that indicated that I should fax to the same number my request with only your name specifically on it. I found this to be quite disturbing because who in there right mind sends a letter like that saying “fax it to the same number” instead of just directing the copies to “Court Reporter/Court Reporting Services.”

It is also important to note that the letter I received on May 8^th, 2006 was postmarked May 5^th, 2006 showing that the letter was backdated to May 2^nd, 2006 and sent out AFTER my second request had already been faxed. This

This is a delay tactic that is a common occurrence at Kent County and is unacceptable. There is perfidy in the air, especially if suddenly after one week's time of deliberate delay the tapes are suddenly missing or destroyed.

Please respond to the attached correspondence as early as possible. Thank you.

What the Hell Kinda Delay Tactic Is This One?

Now what the hell kinda delay tactic is this one? You fax something to the Judge's Office addressed to his Clerk (who runs his little office) and indicating that it needs to go to the Court Reporter right in the heading and the cover sheet. They in turn sit on a letter for three days, mail it out after my second request and back date the letter, and then indicate for me to turn around and fax to the same number and change the name. This is the type of stuff that is going to be great ammo against these common criminals in the near future.

Here is another example of how the Kent County Judiciary works against litigants that are bucking their little Federal leaching system.

I received a letter that was dated "May 2, 2006" postmarked "May 5, 2006" and received May 8th, 2006. This one tops off the runaround letters of the day from the Kent County Federal leachers.

This was in response to my two requests for audio transcripts that was addressed to Jacqueline Flowers (the Judge's Clerk) to be directed to COURT REPORTING SERVICES/COURT REPORTER.

"Judge Hillary's Court Reporter is Ms. Beverly J. Goldsworthy, and she can be reached by fax at the same fax number that you sent your initial request, or by telephone at (616)-632-5080."

"PP" Walsh gives more advice to the Friend of the Court

Is this how a welfare program is supposed to work folks? High dollar attorney that represents a litigant refers his work to the Title IV-D welfare department that was meant to help the needy? More cause for the cutting of their funds and we are going to succeed! Senators and Representatives in our Congress are looking for ways to save money and Kent County is the perfect example of why means testing should be added to Title IV-D. Since the foc's acknowledgement of my efforts to cut their funding they have ramped up collaboration with Mr. Walsh by over double.

Peter Walsh of Napieralski & Walsh P.C. opens his communication to Daniel J. Fojtik (Kent County Welfare Attorney to Mommy Dearest) like:

"This lazy high dollar attorney is not attempting to tell you, my client's welfare attorney according to Mr. Holland, what to do." I had to laugh at him for this one, he is getting more creative with his writing and is at least putting the correct dates on the past few letters that he has been sending to his companion, Daniel J. Fojtik. It's one big happy family there in Kent County. Be interested to see what goes on in the back room around there.

Here is the full version of Walsh's latest advice to Fojtik. It is funny, as he says "I am not providing any legal advice" and then immediately says "in my opinion the collection of current child support by a wage withholding order is not subject to the automatic stay." Maybe advice is to big a word for PP Walsh.

I received in the mail today a letter from Daniel J. Fojtik dated for May 7, 2006 (Sunday) which is unheard of since the Kent County Friend of the Court staff are union workers who have their own quota system of how much work they do for themselves, similar to the quotas of parents they successfully force out of their children's lives to obtain federal tax payer money. The post mark is actually 5th of this month and is for 32 cents! The Friend of the Court must be taking more lessons from Peter Walsh on how to fix various wrong dates to letters which contradict the postmarks. There are serious concerns with the reliability of the incompetent friend of the courts around Michigan that blindly perform administrative functions without scrutiny in an effort to steal U.S. tax payer money.

Needless to say the letter was a response to my Request for Production to Non Party for Daniel J. Fojtik and John R. Cole alleging that MCR 3.218 is the "exclusive" means to obtaining evidence from the Friend of the Court which simply is untrue. More to come on this issue later folks.

Walsh provides free legal advice to welfare services department.

Mr. Peter Walsh sent an interesting fax to the Kent County Welfare Attorney (Daniel J. Fojtik, Kent County Friend of the Court) today. This welfare attorney works with Mommy Dearest (Annalise McMenamin, Wyoming, MI) and Peter Walsh. It basically gives wrongful advice to the welfare attorney, in which he was unsure of in the first place and has attempted to ask for legal advice from a Chapter 13 Bankruptcy Trustee handling my voluntary petition. (Peter Walsh isn't the smartest cookie in the Jar.)

More interesting Mr. Walsh began complaining about some faxes that he alleged I sent out. This was pretty funny, because he says that "Mr. Holland has the time and money to fax defamatory material from one side of the state to the other" in which led me to check with the software provider on how hundreds of faxes were sent out. They indicated they had a software glitch that caused the resending of faxes from about 5 months ago to people. That effort cost me no money and no effort, and although not authorized by me, definitely was pleasant to hear. The truth is not defamatory and it is also important to note that defamation cannot occur with public officials and Peter Walsh regularly makes a fool of himself to the public and to his peers when he alleges such ignorant things. He already got caught making false statements and altered evidence to government officials, so now he will try to take the light off his own deceptive practices. See my letter to Daniel J. Fojtik below.

Re: McMenamin v. Holland

Mr. Daniel J. Fojtik,

I received a copy of one of Mr. Peter Walsh’s friendly coaching letters to the Kent County Title IV-D Welfare Services Department, directed to your attention. How does it look to have a paid attorney of a client ordering a welfare services attorney to do his bidding? I find it particularly interesting because it takes away from what Title IV-D welfare was intended for, which was to assist the needy and poor, instead you have a lazy high-dollar attorney telling the welfare department what to do. This is why my efforts have been so focused on removing the funding from your organization, and I assure you that I will be successful.

I am not in a position to give you legal advice; however I do know that Federal Law prevents you from doing what Mr. Peter Walsh claims in his advisory opinion to the Kent County Title IV-D welfare services department. If you proceed in this manner, I am aware that there are remedies for me as well as substantial case law supporting my position.

Additionally, Mr. Peter Walsh is alleging that I started circulated some type of “rant,” which is untrue. In fact a software company that developed the particular application used to fax has provided me a letter that indicates they had a system failure and they reverted back to a prior version from backup which cued up thousands of faxes from many customers and inadvertently sent them out. Needless to say, it didn’t cost a dime, and took no time. I also don’t think that the fax that was sent out had any rant or defamatory material enclosed and it merely presents a point of view regarding the corrupt nature of the proceedings that have occurred up to a certain point, in which he, you, and the other actors have engaged in to acquire federal funds from the U.S. tax payers.

Request for Production to Kent County Friend of the Court Staff

The Kent County Friend of the Court, John R. Cole, was Ordered to Appear and to Produce certain documents at trial on May 3, 2006 but that hearing was dismissed by way of an Automatic Stay provision. So I have served a Request for Production to Non-Party in which they have 14 days to respond with the answers.

Additionally the Kent County Friend of the Court Staff Attorney, Daniel J. Fojtik, was Ordered to Appear and to Produce certain documents at the same trial on May 3, 2006. I have also served a Request for Production to Non-Party in which they have 14 days to respond with answers.

This will prevent further delay from obtaining communications between certain Judges, John R. Cole, Daniel J. Fojtik, and other representatives that may relate to my case or lead to other pertinent evidence.

Well, there is no surprise that Judge G. Patrick Hillary's office has not replied to the letter that I sent to his office on May 1, 2006 requesting a copy of the transcript from the last hearing. This type of conduct just goes to show you what Kent County's intent is. Similar to how Judge G. Patrick Hillary's office reviews a media request, signs subpoenas, and then renigs on the media requests making him look like a complete moron, especially in front of attorneys that have been planted in the audience to observe his behavior and had prior knowledge of what was going to happen. These officials have become more than predictable. Read on for my SECOND request for the transcripts to Judge G. Patrick Hillary's Office. They will likely try and delay these as long as possible which was also anticipated.

I received a call from Daniel J. Fojtik (Welfare Attorney for Annalise McMenamin) indicating that an Order to Show Cause scheduled for tomorrow had been dismissed. This is after they were already advised that there was a Chapter 13 Automatic Stay in place last Friday, but they needed a couple of extra days to figure out if it affected them. (Daniel J. Fojtik, Peter Walsh, and Judge G. Patrick Hillary)
