The "term kangaroo court" is one that I have used in the past to define a court that has a predetermined outcome. Typically these courts and courtrooms have a predetermined outcome based on some obligation to generate revenue for the state or their own budgets, which most would say is a conflict of interest. The family court and most traffic courts have this function. I am not the only one that defines a kangaroo court in this fashion, which prompted me to find out what the popular website "Hot for Words" said about the term.

Quiet please...

In the video you see that the host notes that a Kangaroo Court is a "court that is improperly run" and that "leads to its conclusion very rapidly" with a predetermined outcome. She also states that the term originated early in the State of Texas. Don't believe me, believe the lady with the degrees folks.

So, now you have heard what the term Kangaroo Court means from Marina Olova. Maria Olova is known to millions across the Internet as a "Sexy Master of Language, HotForWords. Hailing from Moscow, Marina has two degrees in philology.

Philology is the study of linguistics and origins of words.

Lary Holland is someone that is appalled by Kangaroo Courts.

Another example of how an adversarial family court process turns deadly...

The fight broke out at a home on the 200 block of Bodfish Canyon Road in Bodfish. Crystal Lee Parker, 29, lives at the home and had armed herself with a large knife after people arrived because of the child-custody dispute, according to the sheriff's office.

A Kernville man died Monday night after allegedly being stabbed during a child-custody dispute. (Bakersfield Now Eye Witness News; Kernville man dies after stabbing in child-custody dispute; May 26, 2009; Orig.)

Family Court related violence is becoming more prevalent throughout the country as spouses aim to kill one another rather than go to trial. This isn't the first time that family court turns out to be deadly business either, just take a look at this article that continues to mount evidence against an adversarial court system that is proven bad for families. Family Court is Deadly Business.

Get Your Justice Live, an online interactive talk show discussing issues relating to government policies affecting the family, encourages diversion programs to remove a significant portion of cases from the judicial docket, staying the cases, and moving them to pilot programs focusing on alternative dispute resolution. A free seminar, "Save Our Kids", promotes a viable alternative to the adversarial family court system with the ADR method known as Collaborative Law. With a reduction in the bloated judicial dockets, judicial resources will be free to deal more intimately with the high-conflict family court cases before they escalate to critically dysfunctional levels that drive people to destructive acts against other family members.

Some of you may have heard that Family Court is a Deadly Business. Well, tonight I will be updating this article again with no less than 5 more deaths associated with the adversarial family court system. The original article source is:

Family Court is Deadly Business

Check it out and start linking it anytime you see a death, murder-for-hire plot, or suicide associated with the Family Court System. It is never just a local problem. It is everywhere and it needs to stop now. Watch for more articles tonight!
.

What good is an order like the one described below for society? Removing Judge David Niehaus should be a high priority, especially since both the mother and the daughter came forward and claimed responsibility for the daughter not receiving her GED. Further, the father has no ability to purge himself based on his OWN ACTS, it is contingent on SOMEONE ELSE'S PERFORMANCE. The order is blatantly unenforceable as it is written.

GET OFF THE BENCH COVERED THIS STORY ON MAY 13, 2008

PRESS RELEASE FROM CAFCUSA.ORG.

Judge Orders Man to Jail After Adult Daughter Fails to Get a GED; Sparks Call for National Protest by Both Men and Women

The California Alliance for Families and Children (“CAFC”) today called for a national protest by both men and woman over an Ohio judge’s order to jail a father for 180 days, because his daughter did not get her General Equivalency Diploma (GED).

Michael Robinson, Executive Director of CAFC, said, “This is one of the most outrageous court rulings we have seen in a long time – and that’s saying something. Under the judge's logic, more than a million men and woman alike -- who are parents of high school dropouts -- should all be put in jail. This judge is out of control, and should be immediately removed from this case.”
Butler County Juvenile Court Judge David Niehaus ordered Brian Gegner to jail for contributing to the delinquency of a minor by not following a court order, an order which required Gegner to be sure that his daughter got her GED. While the father had technical custody, the daughter actually lived with her mother while she was truant from school.

ABC station WPCO reported that the daughter, Brittany Gegner -- who is now 18 -- says the order is “ridiculously wrong,” adding that if anyone should go to jail, she should and not her dad. Brittany was quoted: "I'm about to be 19 and my Dad's being punished for something I did when I was 16," she said. "I would way rather me go to jail than my Dad."

Her mother also volunteered to go to jail. "They probably should have punished me if they were going to punish
anybody," said Brittany's mother, Shana Roach. "Because she did live with me at the time, but because he had the custody, that's why he's being punished." "But I don't understand the punishment all together, because she's going to school, she's been going for four months," said Roach. "The only thing that's holding her back is she can't pass her math test."

A copy of the full story can be found at:
http://www.wcpo.com/news/local/story.aspx?content_id=28d2acca-9947-44cc-8831-9859f1f6137e

Contact: Michael Robinson
(916)749-4033

This press release is also available in PDF format:
http://www.cafcusa.org/pressreleases/2008/05/12/2008-05-12--CAFC-Press-Release.pdf

###

Judicial Watch: Judge Martha Anderson and Judicial Candidate David Carl Anderson Accused of Elder Abuse by own Mother and Sister.

UPDATE! Listen to Get Your Justice Live

Oakland County Judicial Candidate David C. Anderson and Judge Martha Anderson have been accused by their own mother and sister of elder abuse.

By Lary Holland

Family Court Reports: http://www.laryholland.com/serendipity

GetYourJusticeLive.Com ((Wednesday Night Host))

(1/29/2008)

Oakland County, MI. Elder abuse is a term referring to any knowing, intentional, or negligent act by a caregiver or any other person that causes harm or a serious risk of harm to a vulnerable adult. On January 28, 2008 an interview was conducted by Lary Holland with Diane Anderson on the subject of elder abuse. The interview of Diane Anderson implicates and alleges that both the Oakland County Judicial Candidate David Carl Anderson and, his wife, sitting Oakland County Family Court Judge Martha Anderson are involved in a case of Elder Abuse against Jewell Ann Anderson, Mr. Anderson’s own mother. Diane Anderson is the sister of David Anderson and Daughter of Jewell Anderson.

According to the National Center on Elder Abuse the specificity of laws varies from state to state, but broadly defined, abuse may be:

Physical Abuse - Inflicting, or threatening to inflict, physical pain or injury on a vulnerable elder, or depriving them of a basic need.

Emotional Abuse - Inflicting mental pain, anguish, or distress on an elder person through verbal or nonverbal acts.

Sexual Abuse - Non-consensual sexual contact of any kind.

Exploitation - Illegal taking, misuse, or concealment of funds, property, or assets of a vulnerable elder.

Neglect - Refusal or failure by those responsible to provide food, shelter, health care or protection for a vulnerable elder.

Abandonment - The desertion of a vulnerable elder by anyone who has assumed the responsibility for care or custody of that person.

The complete interview that implicates and alleges the misconduct of David and Martha Anderson is available for listening at http://www.getyourjusticelive.com under the title Special Edition: Elder Abuse, Episode 53 or a copy of the interview file may be downloaded to your IPOD at .

The Family Court System has its' fair share of problems, but one of those problems that has not had a very thorough review is that it is an ever-increasing "Deadly Business." In fact, I didn't even start thinking about the effects of our country's public policies regarding single-parent custody awards and "unilateral divorce" until my recent involvement and trip in Frederick, Maryland. For the most part, I only looked at the effects inside the courtroom specifically, not outside.

The way that divorces, child custody, parenting time, child support, and legal separation issues are "settled" in the United States seems to exacerbate the conflict rather than resolve the conflict between litigants that have a child in common. In the United States there are a super-majority of cases involving minor children that appear on adversarial dockets as opposed to alternative dispute resolution dockets. Parents on both sides of the gender issue seem to be frustrated to the point of extreme violence during or after adversarial proceedings involving their minor children.

According to US Department of Justice, reported by the Institute of American Values in Research Brief 12 Commissioned by the National Fatherhood Initiative supported by Grant No.
2006-DD-BX-K003:

Consequently, more than one million U.S. children experience
parental divorce each year. The growing number of divorces has profound
implications for children, mothers, fathers, and society.

There should be substantial concern over the instant murder-suicides, premeditated murders, attempted murders, murders-for-hire, and drastic number of suicides that are occurring in families that are involved with domestic relation suits or family courts around the nation.

In Frederick Maryland, several families over a six month period of time were reported as having ongoing child custody disputes that resulted in death. There are other reports of attempts at murder-for-hire and attempted murders as well. The most recent eye-opener which drew my attention regarding the Thanksgiving Holiday "massacre" that occurred in Frederick County, Maryland is what prompted me to start searching out other occurrences. Information was indeed easy to find and too numerous to list all of the occurrences.

"On Thanksgiving night, police found five dead bodies in the town of Laytonsville, Maryland at 1.5 acre Unity Park. It is believed to have been a murder-suicide with a domestic related motive. Laytonsville, Maryland is a small town that is located about twenty-five miles away from Washington." (Thanksgiving Murder-Suicide in Laytonsville, Maryland; Associated Content, November 24, 2007)

"A man shot and killed his ex-wife, their three children and himself in a small-town park where they had met for the woman to hand over the youngsters for a visit, investigators said Friday." (Police: 5 Dead in Murder-Suicide in Md; Associated Press, November 23, 2007)

The above is not the first of these type of murder-suicides in the Frederick County, Maryland area. The above Associated Press article also reported in the same article that:

"In April, a father hanged his two young children before committing suicide in rural Boyds, in Montgomery County. In March, the remains of four young children were found in a town house in neighboring Frederick. The father's body was found hanging from a bannister, and the mother remains missing."

"There is a trend that demonstrates that custody and family court litigation has dire consequences when allowed to continue as adversarial proceedings. One party often finds themselves at the tail-end of a powerstruggle that results in a level of hopelessness. When someone feels that they have nothing else to lose, they can become unpredictable," states Lary Holland, Host of Get Your Justice Live and author of this document.

Looking through the various newspapers there are demonstratively a large number of articles that support that ongoing adversarial child custody disputes are resulting in disastrous conseqences. Pro Wresler, Chris Benoit, is one of those cases that resulted in a murder-suicide, along with the high-profile case of Darren Mack who was involved in the shooting of a family court judge and the slaying of his ex-wife.

Annie Gowen of the Washington Post on February 20, 2002 in her article, Custody Battle Probed in Double Slaying:

In the cold pre-dawn hours Friday, Alan G. Bates left his Frederick town house to fly to Birmingham for a deposition in a bitter child custody battle with his ex-wife.

Later, in Birmingham, Bates and his ex-wife, Jessica McCord, faced off over a conference table in a downtown law office.

Bates had planned to pick up his two daughters for the weekend that night. Instead, his body and the body of a woman [were discovered].

Nelson Hernandez also of the Washington Post on September 28, 1005 in his article, 2nd Trial of Lawyer Accused in Plot to Kill Husband Opens; Prosecutors Cite Lost Custody Battle states:

The Bethesda lawyer accused of conspiring with her best friend to kill her estranged husband as a way of resolving a bitter child custody battle went on trial in Frederick County yesterday, nine months after Maryland's highest court threw out her conviction by a Montgomery County jury.

The Wichita Eagle on April 4, 2003 reported in the article Child Custody At Heart of Murder-Suicide that:

When Eric Leckenby confronted his girlfriend's ex-husband with a gun Wednesday, he had already decided neither man would leave alive.

The Miami Herald reported on December 5, 2007 in an article entitled Tragic Couple Went to BSO Before Dying, "A Weston man and his wife visited the Broward Sheriff's Office the day before they perished in a murder-suicide" and further stated that:

"Her husband, Frank, was with her and, according to the BSO report, they were there to discuss ''a child custody'' dispute.

The BSO log, obtained by The Miami Herald, indicates the couple, who were in the midst of a bitter divorce, arrived about 5:30 p.m. and stayed in the lobby of BSO's Weston office for 45 minutes."

The Fresno Bee reported on December 4, 2007 in an article carrying the title Dead Couple Fought Over Custody, "Pair in Tulare murder-suicide sought court orderes" and further stated that:

"TULARE -- A bitter dispute over custody of a 17-month-old daughter may have factored into a late-night murder-suicide in a dark cemetery."

Some of the most recent deaths also have occured in Michigan, where two families in as many weeks have had custody disputes surrounding plots to murder other family members. "The issue of post custody hearing slayings goes beyond the simple issue of domestic violence and is indicative of a larger problem with the system itself," states Holland.

The Kalamazoo Gazette on December 12, 2007 in the first line of the story titled Custody may be linked to killing of woman states as follows:

"PULLMAN -- Investigators believe the death of a 19-year-old woman Tuesday at a house in Allegan County's Casco Township may have been linked to an ongoing child-custody issue, police said."

Other papers covering the aforementioned story in Alleghan county slated the story as being the second tragic incident in the past week, which should raise significant pressures on the local family court to explain what some of the possible factors are in the most recent tragedies. One of the tragedies involved an ex-wife allegedly using her current husband to kill her ex-husband which was widely reported in Western Michigan.

Similar plots and outcomes were involved in at least four known cases of domestic dispute slayings in the past year around Michigan involving Pro Wrestler Chris Benoit, a mutilation story, and now the two Alleghan incidents.

Given that the divorce rate is certainly not on the decline and no expectation of a decline over couples fighting over money, power, and children in the future, there should be a reasonable prediction that there are more tragedies to come. "A serious review of the family courts nationwide should be placed as a high priority when selecting candidates for the upcoming election because the current social institution has definitely failed the families listed in this article," states Holland.

In this NewsDay.Com article the Court says that a sperm donor is liable for child support without giving the father any opportunity to even prove whether or not he is the father.

Nassau County Family Court Judge Ellen Greenberg ruled on Nov. 16 that despite
the mother's willingness to have the child's DNA tested, the man was barred
from seeking a paternity test to determine if he is truly the father because
the results could have a "traumatic effect" upon the child, who is
now 18 years old and lives in Oregon with the mother. The next step is a
meeting with a support magistrate to determine the amount of child support
payments - if any - the man would have to pay until the teen turns 21, Kelly
said

Just another example of how the child support enforcement industry wants to increase the numbers and collection rates to justify their own existence. Read the complete story below.

newsday.com/news/local/crime/ny-lifath015484074dec01,0,1707390.story

I also enjoyed and agreed with a statement that she recently made about the "Men's Rights Movement."

As those who actually read my
words before calling for my violent, agonizing death know, I believe
there is a serious imbalance in the family court system that puts men
at a disadvantage, an imbalance that could be corrected if this MRM
could graduate from the 5th grade.

I don't normally give my self a title of Men's Rights Activist or Father's Rights Activist. It seems to be something that others assign to me because of my complaints overcasting the family court system in general. I tend to shift more towards taxpayer issues, government intrusion and state powers issues, and equality issues. Limiting special interest involvement in government to prevent continuous teeter-totter like power struggles. The same power struggles that show themselves in the family court system, exist in government policy. Both are tumultuous and competitive power struggles.

Now there are a couple of points that I want to make with regard to what is happening in Frederick, Maryland. I actually met with criminal law attorneys and the main issue
with the local Frederick Court system is the amount of death that has
occurred in the past 6 months here. It is simply too many families that
have turned to drastic violence as a "way out" of the family court
system.
Judge Dwyer just happens to head up the community's
court system where the latest tragedies have happened. There is no evidence that he is personally or directly
responsible for those violent outcomes. We need to focus on positive
outcomes with these families that are pitted against each other instead of the current adversarial system
that is destroying the community and society in general. Pitting parent
against parent has disastrous consequences. We need to get the
attention of legislators and judicial officers to discuss the critical
nature of our family court system.

I hope people encourage positive results through some political pressures,
which hopefully draw people to the table to talk about the disastrous
effects of family court. In a few hours I think I demonstrated that I would personally be able to unseat a single position of power in a very short amount of time. However, the issues in Federick County, Maryland is a greater problem than just one judge
or even one person. The issues are a problem associated with how the system works,
not with the employees that are carrying out their day to day duties. The individuals carrying out the duties have the ability to help reshape the system from financially motivated with negative outcomes to results based with positive outcomes.

I ventured back in July to speak further to the Flint City Council. See below the presentation that I provided again to the Flint City Council. Also, Council Member Jackie Foster Poplar spoke in support of the bill and indicated that she issued a letter to Lansing about supporting House Bill 4564. She also told her side of the story in the below video which I encourage all of you to view. You can also send letters/emails of support directly to Jackie Poplar at jpoplar@cityofflint.com thanking her for supporting this critical issue.
