    &lt;p&gt;Entrusting government officials to do the right thing nowadays, just doesn&#039;t seem very logical. As government growth continues to advance, citizen oversight seems to diminish in many key areas. Indystar.Com reported online that forgery charges were filed against ex-state worker (Indystar.Com; Forgery Charges Filed Against Ex-State Worker; Feb 10, 2010; &lt;a title=&quot;Forgery Charges Filed Against Ex-State Child Support Worker&quot; target=&quot;_blank&quot; href=&quot;http://www.indystar.com/article/20100210/NEWS02/2100375/Forgery-charges-filed-against-ex-state-worker&quot;&gt;Orig.&lt;/a&gt;) involving more theft of child support refunds.&lt;/p&gt; &lt;br /&gt;
&lt;blockquote&gt; &lt;p&gt;&lt;em&gt;Marion County prosecutors have filed forgery charges against a former state worker in connection with stolen child-support refunds.&lt;br /&gt;&lt;br /&gt;James Lewis Parker, 47, was charged Monday with two counts of forgery as a Class C felony. Each charge carries a potential penalty of two to eight years in prison.&lt;/em&gt;&lt;br /&gt;&lt;/p&gt; &lt;br /&gt;

&lt;p&gt; The various child support enforcement agencies need more transparency and accountability to ensure proper handling of significant portions of our nation&#039;s economy. As child support debt, orders, and associations expand exponentially, the crimes associated with these agencies increases as well.&lt;br /&gt;&lt;/p&gt; &lt;br /&gt;

    &lt;p&gt;A recent newspaper article caught my attention coming out of Florida. &lt;strong&gt;$28M in Child Support Payments Go Untouched in Florida&lt;/strong&gt; (AVVO.COM April 20, 2009) claimed that &amp;quot;&lt;em&gt;According to a report from the Orlando Sentinel, the state of Florida is holding onto $28 million in child support payments because it can&#039;t figure out which parents should receive the money.&amp;quot;&lt;/em&gt;&lt;/p&gt; &lt;br /&gt;
&lt;p&gt;The part that gets interesting is that more than $5 million of the money has been sitting there for five years or more. When I read that, I decided to look further into the State&#039;s laws pertaining to &amp;quot;unclaimed funds&amp;quot; and what the state does to regarding &amp;quot;proceedings to recover escheated property.&amp;quot; The laws in Florida are stated under Chapter 716 of the Florida Code, entitled &amp;quot;Escheats.&amp;quot;&lt;/p&gt;&lt;br /&gt;
&lt;p&gt;Basically the State of Florida is going to be able to make at least $5,000,000.00 for being inept at distributing child support. The appropriate law dealing with Escheat (transfer to the state budget) is 716.02 and states:&lt;br /&gt;&lt;/p&gt; &lt;br /&gt;
&lt;p&gt;&lt;strong&gt;716.02&amp;#160; Escheat of funds in the possession of federal agencies.&lt;/strong&gt;--All property within the provisions of subsections (1), (2), (3), (4) and (5), are declared to have escheated, or to escheat, including all principal and interest accruing thereon, and to have become the property of the state. &lt;/p&gt; &lt;br /&gt;
&lt;blockquote&gt;&lt;br /&gt;
&lt;p&gt;(1)&amp;#160;&amp;#160;All money or other property which has remained in, or has been deposited in the custody of, or under the control of, any court of the United States, in and for any district within this state, or which has been deposited with and is in the custody of any depository, registry, clerk or other officer of such court, or the United States treasury, which money or other property the rightful owner or owners thereof, either: &lt;/p&gt;&lt;br /&gt;
&lt;p&gt;(a)&amp;#160;&amp;#160;Has been unknown for a period of 5 or more consecutive years; or, &lt;/p&gt;&lt;br /&gt;
&lt;p&gt;(b)&amp;#160;&amp;#160;Has died, without having disposed thereof, and without having left heirs, next of kin or distributees, or&lt;/p&gt;&lt;br /&gt;
&lt;p&gt;(c)&amp;#160;&amp;#160;Has made no demand for such money or other property for 5 years;&lt;br /&gt;are declared to have escheated, or to escheat, together with all interest accrued thereon, and to have become the property of the state.&lt;/p&gt; &lt;br /&gt;
&lt;/blockquote&gt;&lt;br /&gt;
&lt;p&gt;So if someone is unable to bring the proper action under 716.07 of the Florida Code within 5 years, their claim will be forever barred and the money will become the property of the state, rather than the property of the children or returned back to whoever it was originally taken from.&lt;/p&gt;&lt;br /&gt;
&lt;blockquote&gt;&lt;strong&gt;716.07(1) &lt;/strong&gt;&lt;strong&gt;Recovery of escheated property by claimant&lt;/strong&gt;. Any person who claims any property, funds, or money delivered to the Treasurer or Chief Financial Officer under this chapter, shall, within 5 years from the date of receipt of such property, funds, or money, file a verified claim with the Chief Financial Officer, setting forth the facts upon which such party claims to be entitled to recover such money or property. All claims made for recovery of property, funds, or money, not filed within 5 years from the date that such property, funds, or money is received by the Chief Financial Officer, shall be forever barred, and the Chief Financial Officer shall be without power to consider or determine any claims so made by any claimant after 5 years from the date that the property, funds, or money was received by the Chief Financial Officer.&lt;/blockquote&gt; &lt;br /&gt;
&lt;p&gt;The original article didn&#039;t raise any of the points about the state being able reward itself for getting away with failure to distribute money that it collected from one parent in the State&#039;s Title IV-D program. One has to ask the question on why the money is not returned to the person that paid in at the end of the 5-year period and why the State gets to tack on fees, keep the money, and otherwise benefit from doing a poor job.&lt;/p&gt;

her position in January, DSS Commissioner William Moon said Friday.&lt;/span&gt;&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;The story doesn&#039;t end with this Trout Creek woman stealing the money. Who is going to pay back the children and the taxpayers? Inadequate supervision is what we have been saying all the long. Again, what is Congress doing to tie up the State&#039;s lack of professionalism in operating programs where they claim to be helping needy families, while stealing the money out from underneath them. This particular investigation took over 4 years to detect the outright theft.&lt;/p&gt;&lt;blockquote&gt;&lt;span&gt;&lt;p&gt;&lt;font color=&quot;#ff0000&quot;&gt;&lt;b&gt;State Comptroller Thomas P. DiNapoli released an audit Friday&lt;br /&gt;

&lt;p&gt;The audit, requested by Northrup, also found that there was&lt;br /&gt;
inadequate supervision of personnel responsible for collecting and&lt;br /&gt;
depositing child support funds. &lt;/p&gt;&lt;/span&gt;&lt;/blockquote&gt;&lt;p&gt;&lt;/p&gt;&lt;p&gt;Taxpayers are currently footing the bill, largely for their&lt;br /&gt;
government to collect and process child support payments for middle and&lt;br /&gt;
upper class families. Actual needy families appear to be the minority&lt;br /&gt;

In fact District Clerk Donna Phillips has all but been convicted of &amp;quot;allegedly&amp;quot; &lt;span class=&quot;template&quot;&gt;&lt;span class=&quot;body&quot;&gt;&lt;b&gt;taking $15,758.16&lt;/b&gt; from child support accounts.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&lt;span class=&quot;template&quot;&gt;&lt;span class=&quot;body&quot;&gt;&lt;p&gt;NACOGDOCHES — Nacogdoches&lt;br /&gt;
District Clerk Donna Phillips has been arrested and charged with theft&lt;br /&gt;
by a public servant, a third-degree felony. She was arraigned Thursday&lt;br /&gt;
morning by Precinct 2 Justice of the Peace Dorothy Tigner-Thompson, who&lt;br /&gt;
set her bond at $8,500. She was immediately released after bonding out&lt;br /&gt;
of jail.&lt;/p&gt;&lt;br /&gt;

support account she oversees.&lt;/p&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;Not too mention, on April 1, 2008 it wasn&#039;t a laughing matter for Cynthia Woodard who had to plead guilty to multiple charges resulting from her and her fiance&#039; stealing $10,660.00 or more dollars from taxpayers and children. The Statesman Journal in Salem, Oregon reports:&lt;/p&gt;&lt;blockquote&gt;&lt;p class=&quot;sjarticle-copy&quot;&gt;A former Oregon Department of Justice&lt;br /&gt;
employee accused of stealing unclaimed child-support payments from the&lt;br /&gt;

resident Cynthia Diane Woodard, 50, pleaded guilty to two counts of&lt;br /&gt;

participating in the program. The state police have indicated that&lt;br /&gt;
there are more than $300,000.00 worth of goods that the employee has in&lt;br /&gt;
her possession that were purchased with at least one government credit&lt;br /&gt;

Part D of the Social Security Act if the State programs voluntarily&lt;br /&gt;
comply with federal mandates on how to operate. In the beginning a&lt;br /&gt;
program to help needy families, it has now turned into a free for all&lt;br /&gt;
welfare spending program where the States focus on revenue generation&lt;br /&gt;
instead of helping actual needy families. For every dollar spent by the local agency, two more dollars come into the state as a result of the expenditure. This leads to very poor management of the progam and a significant forced over-participation which is costing taxpayers nationwide.&lt;/p&gt;&lt;p&gt;It&#039;s time to reign in free for all welfare spending where over 45% of&lt;br /&gt;
the participants in the Title IV-D welfare program are middle to&lt;br /&gt;
upper-class families that should be paying for their own disputes not&lt;br /&gt;
feuding on tax payer money. Shrink back the program for its intended&lt;br /&gt;
beneficiaries and shave off nearly 30,000 government employees&lt;br /&gt;
nationwide to help control taxpayer waste, fraud, and government&lt;br /&gt;

&lt;p&gt;I have been following a fair number of reports where individuals are being caught embezzling from the tax payers, committing fraudulent transfers, and identity theft through the various State Child Support Programs. The programs have grown so quickly that there is insufficient oversight to ensure that the programs help those who have need. &lt;p&gt;If it isn&#039;t the actual child support enforcement officers stealing from the taxpayers, then its more greedy participants aiming to defraud taxpayers, parents, and children of green. The Title IV-D program is&lt;br /&gt;
plagued with over participation, fraud, and misrepresentation to the public that money is destined for children, but in reality the money goes into everyone else&#039;s pockets but the children&#039;s. The Katy Times, serving Katy, Tx and the surrounding suburban communities released the story on June 1, 2007 about a Fort Bend, Indiana Woman being found guilty in another Child Support Fraud Scheme. We cannot entrust these employees to manage money, let alone make recommendations to what is best for our children.&lt;/font&gt;&lt;/p&gt;&lt;p&gt;Another County employee, this one in Lauderdale County, has been indicted by a grand jury on felony embezzlement charges for allegedly stealing more than $216,000.00 of program money, paid for by taxpayers, by writing unauthorized checks to herself from January 2002 through April of 2007.
